The Prenuptial Agreement deals with property ownership and support obligation issues in contemplation of being married in the future.
If done correctly, the Court will uphold it as a legally binding contract.
The Cohabitation Agreement also deals with property ownership and support obligation issues but is not contemplating marriage in the future.
Cohabitation Agreements may work retroactively if drafted properly and upheld by the Court.
